Terms of Service

Please read these Terms of Service carefully before accessing or using the MOFGHE TOOL CORP website and training platform. Your access to and use of the service is conditioned on your acceptance of and compliance with these terms.

01 Acceptance of Terms

By accessing, browsing, registering for, or purchasing any course, guide, tutorial, or subscription from MOFGHE TOOL CORP (hereinafter referred to as "Company," "we," "us," or "our"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, our Privacy Policy, and our Refund Policy, all of which are incorporated herein by reference. If you do not agree to all the terms and conditions set forth in this agreement, you must not access or use any of our services.

These terms apply to all visitors, users, registered students, and any other person who accesses or uses our platform, including but not limited to our website, mobile applications, downloadable content, video libraries, and any associated services or materials provided by the Company.

We reserve the right to update, modify, or replace any part of these Terms of Service by posting revisions and updates on this page. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes. The date of the most recent revision will always appear at the top of this document under "Last Updated."

02 Eligibility and Account Registration

To access certain features of our platform, you may be required to register for an account. By creating an account, you represent and warrant that you are at least 18 years of age or have obtained the consent of a parent or legal guardian. If you are registering on behalf of a minor under the age of 18, you accept full responsibility for that minor's use of the platform and compliance with these terms.

When you create an account, you must provide accurate, current, and complete information during the registration process and keep your account information up to date at all times. You are solely responsible for safeguarding the password that you use to access your account and for any activities or actions taken under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

The Company reserves the right to suspend or terminate your account at any time, for any reason, including but not limited to violation of these Terms of Service, provision of false or misleading information, or any activity that may cause harm to the Company, its users, or third parties. You may not use as a username the name of another person or entity that is not lawfully available for use, a name or trademark that is subject to any rights of another person without appropriate authorization, or a name that is otherwise offensive, vulgar, or obscene.

03 Course Enrollment and Access

Upon successful enrollment and payment for any course, guide, or tutorial offered by MOFGHE TOOL CORP, you are granted a limited, non-exclusive, non-transferable, revocable license to access and view the content for your personal, non-commercial educational purposes only. This license does not grant you any ownership rights over the materials provided.

Lifetime Access: For courses and guides advertised as including "lifetime access," this means you will have access to the content for as long as the course or guide continues to be offered by the Company on its primary platform. Lifetime access does not mean access in perpetuity if the Company ceases operations, discontinues a specific course, or transitions to a new platform without migrating legacy content. In the event a course is discontinued, we will make reasonable efforts to notify enrolled students at least 30 days in advance and, where possible, provide a downloadable version of core materials.

You may not reproduce, distribute, publicly display, publicly perform, communicate to the public, create derivative works from, or otherwise use or exploit any course content except as expressly permitted under these terms. You may not share your account credentials, download videos for offline redistribution, or use any automated means to scrape or copy content from our platform.

04 Payment Terms and Pricing

All prices for courses, guides, tutorials, and subscriptions are listed in United States Dollars (USD) unless otherwise stated. The Company reserves the right to change pricing for any product or service at any time without prior notice. However, any price change will not affect purchases that have already been completed and confirmed prior to the price adjustment.

Payment is required in full at the time of enrollment unless a specific installment or subscription plan is offered and selected during checkout. For subscription-based products, you authorize the Company to charge your provided payment method on a recurring basis according to the billing cycle you selected. You are responsible for ensuring that your payment information remains current. If a payment fails, we may suspend your access until the outstanding balance is paid.

All payments are processed through secure third-party payment processors. The Company does not store full credit card numbers or sensitive financial information on its own servers. You agree to comply with the terms and conditions of the applicable payment processor in addition to these Terms of Service.

05 Intellectual Property Rights

All content, materials, and resources provided on or through the MOFGHE TOOL CORP platform, including but not limited to video lessons, written guides, diagrams, illustrations, blueprints, schematics, photographs, text, graphics, logos, button icons, audio clips, digital downloads, data compilations, software, and the overall design and layout of the website, are the exclusive property of the Company or its content suppliers and are protected by United States and international copyright, trademark, and other intellectual property laws.

The trademarks, logos, and service marks displayed on the platform are registered and unregistered trademarks of the Company and its affiliates. Nothing contained on the platform should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark without the prior written permission of the Company.

Any unauthorized use, reproduction, modification, distribution, transmission, republication, display, or performance of the content or materials on this platform is strictly prohibited and may result in legal action. The Company actively monitors the internet for unauthorized distribution of its course materials and will pursue all available legal remedies including, but not limited to, claims under the Digital Millennium Copyright Act (DMCA).

06 User Conduct and Prohibited Activities

In using the MOFGHE TOOL CORP platform, you agree not to engage in any of the following prohibited activities:

  • Using the platform for any illegal purpose or in violation of any local, state, national, or international law.
  • Sharing, selling, or transferring your account credentials or course access to any third party.
  • Downloading, recording, screen-capturing, or otherwise copying video content from the platform without express written permission.
  • Attempting to circumvent, disable, or otherwise interfere with security-related features of the platform.
  • Uploading or transmitting any viruses, malware, or any other type of malicious code that may affect the functionality or operation of the platform.
  • Using any robot, spider, scraper, or other automated means to access the platform for any purpose without our express written permission.
  • Harassing, abusing, insulting, harming, defaming, slandering, disparaging, intimidating, or discriminating against any Company employee, contractor, instructor, or other user.
  • Submitting false or misleading information, including impersonating another person or entity.
  • Using course content to develop a competing product or service.
  • Violating the terms of any third-party license or agreement applicable to software or content used on the platform.

We reserve the right to terminate your use of the platform or any related service for violating any of the prohibited uses at our sole discretion, without prior notice, and without refund of any fees paid.

07 Disclaimer of Warranties and Limitation of Liability

Educational Purpose Only: The content provided by MOFGHE TOOL CORP is for educational and informational purposes only. While we strive to provide accurate, up-to-date, and practical instruction on home repair, tool usage, and household maintenance, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, or availability with respect to the content for any particular purpose. Any reliance you place on such information is strictly at your own risk.

Safety Acknowledgment: Home repair, construction, electrical work, plumbing, and tool usage involve inherent risks including but not limited to physical injury, property damage, and in extreme cases, death. You acknowledge that you are solely responsible for your own safety and the safety of others when applying techniques demonstrated in our courses. You should always follow manufacturer instructions, local building codes, and safety regulations. When in doubt, consult a licensed professional.

No Guarantee of Results: The Company does not guarantee that you will achieve any specific outcome, including but not limited to cost savings, successful project completion, or skill acquisition. Individual results depend on numerous factors including your own aptitude, effort, tools used, materials selected, and environmental conditions, all of which are beyond our control.

To the fullest extent permitted by applicable law, in no event shall MOFGHE TOOL CORP, its officers, directors, employees, contractors, instructors, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the platform, any conduct or content of any third party on the platform, or any content obtained from the platform.

08 Indemnification

You agree to defend, indemnify, and hold harmless MOFGHE TOOL CORP, its officers, directors, employees, contractors, instructors, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to reasonable attorney's fees) arising from: your use of and access to the platform; your violation of any term of these Terms of Service; your violation of any third-party right, including without limitation any copyright, trademark, property, or privacy right; or any claim that your actions caused damage to a third party. This defense and indemnification obligation will survive these Terms of Service and your use of the platform.

09 Termination

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these terms at any time by notifying us that you no longer wish to use our services and by closing your account. Upon termination, your right to access the platform and all course content will immediately cease.

We may terminate or suspend your account and bar access to the platform immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these Terms of Service. In the event of termination for cause, no refund of any fees paid will be provided. All provisions of these terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10 Governing Law and Dispute Resolution

These Terms of Service shall be governed and construed in accordance with the laws of the State of Montana, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these terms, or the breach thereof, shall first be attempted to be resolved through informal negotiations between the parties. If the dispute cannot be resolved informally within 60 days, the parties agree to submit the dispute to binding arbitration in Missoula County, Montana, in accordance with the rules of the American Arbitration Association. Judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to a jury trial and any right to participate in a class action lawsuit or class-wide arbitration.

11 Severability and Entire Agreement

If any provision of these Terms of Service is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed and the remaining provisions shall remain in full force and effect. The failure of the Company to enforce any right or provision of these terms will not be considered a waiver of those rights.

These Terms of Service, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and MOFGHE TOOL CORP regarding the use of the platform and supersede and replace any prior agreements, communications, and proposals, whether oral or written, between you and us.
